The purpose of DMV Collective’s Privacy Policy (“Privacy Policy”) is to inform you of how DMV Collective manages, collects, uses, processes and discloses your Personal Data, which is subject to the privacy principles set out in the Privacy Act 1998 (Cth) and the Privacy Act 2020 (NZ) and the general law intended to protect your privacy, as amended from time to time.
Protecting our customer’s Personal Data and compliance with Applicable Laws is of the utmost importance to DMV Collective and a matter we take very seriously. We are committed to properly managing, protecting and processing your Personal Data in accordance with the Privacy Policy, which applies to all Personal Data we collect through our Platforms and/or channels.
When you submit information to us, or sign up as a customer on our website to purchase, view or otherwise browse any of the products, services or content offered by us, you agree and consent to DMV Collective (including any Related Corporations and business units) (collectively, the “Companies”), as well as their respective representatives and/or agents collecting, using, disclosing and sharing among themselves your Personal Data and disclosing such Personal Data to the Companies’ authorised service providers and relevant third parties in the manner set forth in this Privacy Policy.
Please read and review this Privacy Policy, which will inform you how we collect, use, process and disclose your Personal Data. This Privacy Policy should be read in conjunction with DMV Collective Terms and Conditions, of which this Privacy Policy forms part. This Privacy Policy supplements but does not supersede nor replace any other consents you may have previously provided to DMV Collective in respect of your Personal Data. We may also collect and process your Personal Data under any exceptions to Applicable Laws, which are not set out in this Privacy Policy. We trust that it will assist you in making an informed decision whether to provide us with any of your Personal Data.
Note this Privacy Policy does not cover information collected from individuals as part of our recruitment and selection process when we engage contractors or onboard staff employed by our labour hire agencies. This Privacy Policy does not apply to the practices of organisations that DMV Collective does not own or control, or to people that DMV Collective does not employ or oversee even if offers, coupons or links to their websites appear within our Platforms or technology.

WHAT PERSONAL DATA DO WE COLLECT?
During our relationship with you, we may collect Personal Data from you. Examples of the types of Personal Data we may collect includes your name, contact details, delivery addresses, email address, birthday, facial image, your shopping and/or browsing behaviours, voice recording (from customer service calls) and any other personally identifiable information that you have provided us in any form you may have submitted to us, or in the course of any other forms of interaction between you and us.
Where such information pertains to an identified individual – Personal Data may also include network and device data such as IP address and device or advertising identifiers and information we obtain using cookies or other tracking technologies. We may also collect information about you from third-party sources and platforms (including data validation services, authentication service providers, social networking sites, online marketing and segmentation providers and ad targeting companies) to supplement the information we collect directly from you.
If you provide us with Personal Data relating to a third-party by submitting such Personal Data to us, you represent to us that you have obtained the consent of the third-party to provide us with their Personal Data for the respective purposes.
By (1) clicking “Yes” on our Privacy Policy pop-up or any web form referring to this Privacy Policy on any of our online Platforms, (2) submitting your Personal Data to us when signing up for an account on the Website, (3) browsing our Website, or (4) ordering any of our products and services, you are agreeing to the terms of this Privacy Policy.
HOW DO WE COLLECT YOUR PERSONAL DATA?
We collect Personal Data from you when:
- You register an account on our Website;
- You use any of our related services, such as subscribing to our newsletter or product notifications;
- You browse our products and services or otherwise interact with our Website;
- You accept our cookies and other tracking technologies on your device;
- You interact with our customer service team or other representatives, agents etc., for example, via in person meeting/interaction, via our website, webportal, webform, chat, emails, telephone calls and/or posted letters;
- You interact with us on our Social Media, including commenting on posts, private messaging and liking posts on our Social Media;
- You sign up to our joint collaboration programs or our affiliate marketing partner network;
- You purchase a gift card, vouchers or QR Code for redemption with DMV Collective;
- You participate in our promotions and giveaways, initiatives or any request for additional Personal Data such as customer surveys and product evaluations;
- Your authorised representative submits your Personal Data to us for any purpose reasonably authorised by you, for example if such representative is purchasing our product or service to be delivered to you or as a gift;
- Third Parties have collected Personal Data from you pursuant to their separate privacy policies, and those Third Parties provide your Personal Data to us; or
- You voluntarily provide your Personal Data to us for any reason.
We do not directly collect your credit card details to process your payment or for customer service purposes. Your credit card details are collected, processed and stored directly by our third-party payment processors (pursuant to their respective terms of use and privacy policies). None of your credit card details are permanently stored with us. However, we may collect your bank account details and other financial information to process refunds and manage outstanding debtor accounts.
HOW WILL YOUR DATA BE USED?
We may use and disclose your Personal Data for purposes necessary to provide you with your products and services, including to:
- Process your order for our products and services;
- Process or collect your payment for an order;
- Facilitate you making payments through alternative payment methods, such as Afterpay, Paypal;
- Deliver the products and perform the services you purchased, including couriers
contacting you to obtain delivery instructions; - Register and maintain your user account and to verify your identity or age;
- Process your returns or refunds in accordance with our Terms and Conditions;
- Communicate with you in relation to our products, services and any questions or
comments you might have in relation to the same; - Personalise and improve your customer experience;
- Monitor and enforce compliance with our Terms and Conditions;
- Ensure our Website functions properly and to improve its performance through
website optimisation, statistical analysis and debugging; and - Comply with any applicable law, regulation or regulator’s directive.

In addition, we may use and disclose your Personal Data for the following purposes, to:
- Send you marketing communications in relation to sales, products, services or promotions of our products and services and/or those products and services of our collaboration partners;
- Deliver personalised advertisements in relation to our products and services and/or those products and services of our collaboration partners;
- Process your participation in our promotions and giveaways;
- Conduct customer feedback research and market research;
- Promote our products and services on our Platforms;
- Store in our Customer Relationship Management files and software for internal administrative purposes within our business; and
- Improve your customer experience through training for our staff, such as by monitoring and recording phone calls and social media interactions with you.

We may also use or disclose your Personal Data for secondary purposes in accordance with applicable laws, or with your further consent.
We may collect information about you in an aggregated manner and anonymous basis, to better assist us to develop products and services and further campaigns related to our products and services and those of our collaboration partners.
WITH WHO WILL YOUR PERSONAL DATA BE SHARED?
In relation to our use of your Personal Data for the Purposes and/or Additional Purposes, we may disclose your Personal Data to:
- Our staff, including employees, managers, contractors, consultants, temporary workers or other agents or representatives;
- Courier, fulfilment or parcel-pickup services who will deliver your order to you, as well as parcel return partners;
- Payment processors, who process payments in relation to your orders, as well as refund payment processors;
- Collaboration partners, business partners or vendors in connection with the processing of any promotion, event or service organised by us;
- Any party to whom you authorise us to disclose your Personal Data;
- Our credit bureaus, professional advisors, bankers and auditors; and
- Agents, contractors or service providers who are part of our business operations, including those that help us to fulfill your orders, created and deliver products and services to you.
We do our best to minimise the disclosure of your Personal Data to the information necessary to perform the related Purpose or Additional Purpose. However, we may also disclose your Personal Data for secondary purposes if the secondary purpose is related to the Purpose or Additional Purpose and you would reasonably expect us to use or disclose the information for the secondary purpose, otherwise in accordance with applicable laws, or with your further consent.
HOW CAN I ACCESS OR CORRECT MY PERSONAL DATA?
You may access or correct your Personal Data, including your name, birthday, shipping and billing addresses by logging in to your user account on our Platforms under [INSERT WEBSITE DESTINATION BUTTON] and clicking the [INSERT NAME] button under each relevant field.
For Personal Data that cannot be corrected by you by logging in to your [user account] on our Platforms, you may request to access and correct such Personal Data by submitting a written request to our [Customer Care Team]. We may need to request additional information from you to confirm your identity before providing the access or making corrections.
Our [Customer Care Team] will do its best to respond and action your requests for access and correction of your Personal Data within 30 days of first receiving your request. While DMV Collective makes reasonable efforts to provide our customers with access to their Personal Data, there may be circumstances in which we are unable to provide such access, including but not limited to where:
- the information requested includes our (or a third party’s) proprietary business information and/or intellectual property;
- the burden or expense of providing access to you would be disproportionate to the risks to your privacy;
- your request would compromise the privacy or other legitimate rights of other persons;
- the information requested is legally privileged; or
- your request is excessive or unfounded.
HOW CAN YOU REQUEST DELETION OF YOUR PERSONAL DATA?
You have the right to request that we delete your Personal Data, or stop processing it or collecting it. Please refer to the following information and procedure on how to proceed with submitting a request to delete your Personal Data.
Deleting your DMV Collective Account
You may delete your account with us by logging into your user account. We will process such a request within a reasonable time from receiving notice from you of your withdrawal of consent. Once the processing is complete, we will no longer collect, use, process and/or disclose your Personal Data, except to the extent we retain your Personal Data for product recall, legal, regulatory, fraud or compliance purposes.
Withdrawing Consent for Marketing Campaigns and Communications
If you no longer wish to receive our marketing communications, you can withdraw your consent to receiving the same by emailing hello@dmvcollective.com.
Once we receive your written notification that you wish to withdraw your consent for receiving our marketing communications, it may take up to 5 business days for your request for withdrawal to process and reflect in our administrative systems. Please note that during this period, you will continue to receive our marketing communications.
If you withdraw your consent for us to use and process your Personal Data for the Purposes and/or the Additional Purposes or for other purposes, we may not be able to provide you with our products and services as well as related benefits associated with our promotions and campaigns.
Other Requests to Delete Your Personal Data
If you wish to submit other requests in relation to the deletion of your Personal Data, please contact our Customer Care Team and we will review them in good faith.
ADMINISTRATION AND MANAGEMENT OF PERSONAL DATA
Please ensure that your Personal Data is complete, accurate, up to date and correct at all times. If you fail to do so, it may result in us being unable to provide you with the products and services you have ordered as well as process and complete your orders. Please promptly update us of any changes to your Personal Data. We are not responsible for the accuracy or completeness of your Personal Data and are not responsible for relying on inaccurate or incomplete Personal Data if you have not updated us of such changes.
We will make reasonable efforts to ensure that your Personal Data is accurate, up to date and correct.
We will also put in place reasonable security processes, procedures and protocols to ensure that your Personal Data remains adequately secure and protected in a manner that prevents unauthorised access, loss, damage, modification, alteration, disclosure, distribution, use or collection of your Personal Data.
We are not responsible for unauthorised use of your Personal Data by third parties where such actions are beyond our control and/or due in part to security limitations of the Internet.
DATA RETENTION AND DESTRUCTION
We will use reasonable measures to destroy or anonymise Personal Data that is no longer for any reason connected to the purpose for which it was originally collected, or retention by us is no longer necessary for any other legal, compliance or business purpose.
We will store your Personal Data in backup archives until its deletion from our business systems and databases.
DISCLOSURE OF PERSONAL DATA OVERSEAS
DMV Collective has customers for its products and services in multiple countries, and as such we process Personal Data in multiple countries.
We may from time to time transfer your Personal Data to recipients who have business operations outside the country of your residence. Any such transfer of your Personal Data will be done by us in compliance with applicable laws
COOKIES
DMV Collective uses Cookies on its Platforms. Cookies are small text files that may be placed on your device to store information in order to recognise you and your device each time you visit our Platforms. We also use Cookies in order to enhance your online experience, including for preference settings, product offer selection, data analytics, conversion attribution and identifying fraudulent behaviour and transactions.
DMV Collective also uses the services of third-party vendors, who may implement one or more persistent Cookies or other tracking technologies. The collection, use, tracking and disclosure of information, including Personal Data, collected by third party Cookies and tracking technologies are subject to the privacy and data protection policies of the third-party vendors and are not under our control.
You can disable Cookies being stored by activating the setting on your browser that allows you to refuse the setting of all or some Cookies. However, please note that this may result in the loss of functionality on our Platforms, restrict your use of our Platforms or disable some features.
